Dear TMS user,
Further to the release notes sent on 1 October 2023, we would like to provide additional clarification in relation to the declaration of football agent information in TMS for transfers under the scope of the preliminary injunction granted by the District Court of Dortmund (Landgericht Dortmund). In accordance with Annexe 3 to the Regulations on the Status and Transfer of Players, clubs are required to declare the football agent’s information when entering a new transfer in TMS. The agents listed in TMS hold a valid FIFA licence, in line with the FIFA Football Agent Regulations. In this respect, please be informed that any club that participates in an international transfer with one of the following features is not obliged to declare the football agent information in TMS.
A club affiliated with the German Football Association (DFB) is involved, and said club has engaged the services of an individual who is not a football agent, i.e. not licensed by FIFA.
A player is to be registered or deregistered with the DFB, and said player has engaged the services of an individual who is not a football agent, i.e. not licensed by FIFA.
A club or player has engaged the services of an individual domiciled in Germany who is not a football agent, i.e. not licensed by FIFA.
In practice, if any of the clubs or the player have engaged the services of unlicensed individuals, all clubs that participated in those international transfers shall answer “No” to the question “Football Agent(s) representing [the club/player] in relation to the transfer” when creating a new transfer in TMS. NB: if the club and/or the player have engaged the services of at least one licensed football agent who is not domiciled in Germany, it shall answer “Yes” to the above question and declare the information pertaining to that licensed football agent in TMS.
