TMS was designed to ensure that football authorities have more information about international player transfers, thereby improving the credibility and standing of the entire transfer system. On 1 October 2010, Annexe 3 to the FIFA Regulations on the Status and Transfer of Players (the “Regulations”) entered into force, establishing rights and binding obligations on the stakeholders involved in international transfers of players, namely Member Associations and clubs.
With over 70,000 transfers of players completed each year, Regulatory Compliance is responsible for ensuring compliance with and the proper application of FIFA regulations, and for ensuring that all clubs and Member Associations act in a transparent, responsive and accountable manner throughout the transfer process. Regulatory Compliance’s responsibilities include educating stakeholders, monitoring transfer activity and, under delegated authority from the FIFA Disciplinary Committee, investigating and, where appropriate, sanctioning certain breaches of the Regulations.

- Investigating technical infringements using the administrative sanction procedure (“ASP”)
- Investigating more substantive breaches using the traditional case file (“TCF”) procedure

Promoting compliance best practices
Awareness
Prevention is better than cure. Check TMS at least once a day so that you are aware of any matters requiring your attention. Through regular monitoring, you will be able to respond promptly, comply with your obligations and avoid breaches of the FIFA Regulations on the Status and Transfer of Players.
Timeliness
Always respond to any communication you receive from Regulatory Compliance promptly and by the deadline imposed. The ASP is designed to be an efficient and rapid procedure, so its deadlines are strictly monitored and enforced. To reduce the risk of incurring a sanction, recipients of an ASP letter must comply with the stipulated deadlines.
Responsiveness
When parties are requested to correct certain non-compliant conduct in TMS, they must also confirm in writing to Regulatory Compliance that they have done so (regulatory.compliance@fifa.org).
