Scenario and prerequisites
Scenario: the player was transferred on loan from club A to club B. At the end of the loan, the player is transferred permanently from club B to club C.
If the player’s employment contract with club A expires at the end of the loan (where the loan has either expired or been mutually terminated), it is important that club A confirms the conclusion of the loan in TMS to confirm that the player no longer has a contractual relationship with their original club.
Transfer after the loan has ended
After the player’s employment contract with club A and the loan agreement between club A and club B have both ended, the player may then be engaged by club C. In this case, club C must enter the appropriate “engage out of contract” instruction in TMS and upload sufficient proof that the player is free of any prior contract. To prove the latter, club C must upload proof of the last contract end date of the player’s employment contract with club B. In this case, the ITC/DTC process will apply accordingly.
Transfer before the loan is closed in TMS
The player may also be transferred to a third club (club C) before the original loan is formally closed in TMS. In this case, when association C requests the ITC from association B, club A will be asked to agree or disagree with the player’s further move to club C via a warning message in ITMS.
Club A agrees
If club A agrees to the transfer of the player, the original loan between clubs A and B is set to “Closed” or “Closed – awaiting payment” status.
Club A disagrees
If club A disagrees with the transfer of the player, it must upload a written statement supporting its position and this statement will be shared with all parties involved in the player’s transfer between associations B and C.
Club A does not respond
If club A fails to respond to the warning message before association B delivers the ITC, then association B will be informed that club A has been requested to agree to the player’s transfer. At this stage, association B has the option to “Continue” and deliver the ITC or “Await response” from club A.
Completing the ITC process
Once club A has stated its disagreement to the player’s transfer, all parties in the player’s transfer between associations B and C are notified through the system and advised to review the written statement from club A that is stored in the transfer history. If they click on “Ignore”, the notification will disappear from the system. These actions are also recorded under the user’s activity history.
At this point, associations B and C can choose to contact club A and come to an agreement or continue with the transfer in progress.
When association B delivers the ITC, it is reminded for the last time of club A’s disagreement. Association B can still decide to continue, in which case association C will then be in a position to register the player.
